Terms of Service

1. Who we are

These Terms of Service (“Terms”) form a binding agreement between you and 90 Labs LLC (“Majat”, “we”, “us”), the operator of the Majat mobile application (“the App”), registered in the Republic of Kosova.

By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. Eligibility

  • You must be at least 13 years old to use the App.
  • You must reside in or be physically located in Albania or Kosova at the time of registration. Country availability may expand later.
  • If you create an account on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Your account

  • You are responsible for keeping your login credentials confidential.
  • You are responsible for all activity under your account, including content you post.
  • Notify us immediately at majat@90labs.llc if you suspect unauthorized access.
  • We may suspend or terminate accounts that violate these Terms (see §10).

4. Acceptable use

When using Majat you agree NOT to:

  • Harass, threaten, or impersonate others.
  • Post content that is illegal, hateful, defamatory, sexually explicit, or that infringes others’ rights.
  • Spam, phish, or send unsolicited commercial messages.
  • Reverse-engineer, decompile, or attempt to extract source code from the App except where law explicitly permits.
  • Use automated tools (scrapers, bots) to access our backend.
  • Bypass security measures, including the premium gating mechanism.
  • Disrupt the service for others, including denial-of-service or rate-limit attacks.

Organization administrators may moderate chats they own and may remove participants who violate these rules.

5. Hike participation and safety

Hiking is a physical activity that involves real-world risk. Majat is a coordination tool, not a guide service. By joining a hike you acknowledge:

  • You are responsible for your own physical fitness, equipment, and safety.
  • The hike organizer is not a licensed mountain guide unless they explicitly state otherwise.
  • Weather, terrain, and other natural conditions can change without notice.
  • In an emergency, dial 112 (emergency services). The “SOS” button in the App is a convenience feature only; it does not guarantee a response.
  • You should follow local laws and protected-area regulations.

We are not responsible for accidents, injuries, lost property, or any other incidents that occur during hikes coordinated through the App.

6. Subscriptions and billing

6.1 Premium subscription

  • “Majat Premium” is an auto-renewing annual subscription priced at €15/year (or local equivalent set by the store).
  • The subscription unlocks features including chat with organizers, advanced filters, and joining/interacting with hikes (free users can browse).
  • Your payment is processed by Apple (App Store) or Google (Play Store), governed by their terms. We do not see your card details.

6.2 Renewal

  • Subscriptions auto-renew at the end of each period unless you cancel at least 24 hours before the renewal date.
  • Manage or cancel via your platform’s settings:
    • iOS: Settings → [your name] → Subscriptions → Majat.
    • Android: Play Store → Profile → Payments and subscriptions → Subscriptions → Majat.

6.3 EU 14-day withdrawal right

  • If you are an EU/EEA consumer, you have a 14-day right of withdrawal from a digital subscription contract.
  • However, by purchasing and beginning to use premium features immediately, you expressly request immediate performance and acknowledge that you lose this right once digital content has been delivered (per Directive 2011/83/EU Art. 16(m)).
  • If you have not yet used premium features, contact majat@90labs.llc within 14 days of purchase for a refund of the purchase price.

6.4 No refunds for partial periods

After the withdrawal window, we do not provide partial refunds for unused portions of an active subscription period. You retain access until the end of the paid period.

6.5 Price changes

We may change prices for future renewal periods with at least 30 days’ advance notice via the App and email. You may cancel before the new price takes effect.

7. Your content

You retain ownership of content you post (hike descriptions, photos, chat messages, reviews). By posting, you grant Majat a worldwide, royalty-free, non-exclusive license to host, display, distribute, and reproduce that content for the purpose of operating the App, including showing it to other users who can see it under the App’s privacy settings.

This license ends for new use when you delete the content (with reasonable technical caveats — backups roll forward up to 30 days).

You represent that:

  • The content is yours, or you have permission to post it.
  • It does not violate anyone else’s rights or any law.

We may remove content that violates these Terms or that we are legally required to remove.

8. Intellectual property

  • The Majat name, logo, app design, and source code are owned by 90 Labs LLC.
  • All rights not expressly granted in these Terms are reserved.
  • You may not use the Majat name or marks without prior written consent.

9. Third-party services

The App relies on third-party services (Firebase, RevenueCat, OpenStreetMap, Apple, Google). We are not responsible for outages, data loss, or other issues caused by those services. Their terms apply when you interact with them.

10. Termination

You may stop using the App at any time and delete your account from Settings → Delete account. See the Privacy Policy §8 for what happens to your data.

We may suspend or terminate your account if:

  • You violate these Terms.
  • We are legally required to do so.
  • The account has been inactive for 36 months (we will notify you first if practical).

11. Disclaimers

To the maximum extent permitted by the law of Kosova:

  • The App is provided “AS IS” without warranties of any kind.
  • We do not guarantee the App will be uninterrupted, error-free, or secure.
  • We do not guarantee the accuracy of hike data, route information, or weather forecasts.

12. Limitation of liability

To the maximum extent permitted by the law of Kosova, our total liability for any claim arising out of these Terms or your use of the App is limited to the amount you have paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, or punitive damages.

These limits do not apply to liability that cannot be excluded by law (e.g., death or personal injury caused by gross negligence, willful misconduct, or where Kosova or EU consumer protection law forbids the limitation).

13. Indemnification

You agree to indemnify and hold harmless 90 Labs LLC and its officers, employees, and agents from any claim arising from:

  • Your violation of these Terms.
  • Your content.
  • Your use of the App in a way that harms a third party.

14. Governing law and venue

These Terms are governed by the laws of the Republic of Kosova, without regard to conflict-of-law principles. Any dispute will be resolved by the competent courts of Prishtina, Kosova, except where mandatory consumer-protection law gives you the right to sue in your country of residence.

15. Changes to these Terms

We may update these Terms. Material changes will be communicated in the App (banner or in-app notification) at least 14 days before they take effect. Continued use of the App after the effective date constitutes acceptance.
